Accidents caused by a spillage of Diesel

Making a Successful Claim
To make a successful claim, a number of conditions have to be met. These are:
- That the diesel spillage was both substantial and negligent
- That your accident and injury must have resulted from that negligence
- You must report the spillage and accident and your injuries, to the police with 14 days of the accident
- You must report the spillage, the accident and your injuries, to the Local Authority responsible for the area in which the accident occurred with 5 days of the accident
The industry agreement with the MIB requires that the diesel spillage should be of such a size that the Local Authority must be required to take some cleansing action. And the location of the spillage must be such as to eliminate the argument that the spillage came from something other than a vehicle. That's why we always advise people involved in diesel spillage claims to take photographs of their accident, the spillage, its location and the injuries caused.
If all these points are OK, then a successful claim can be made.
